Terms & Conditions

These Terms & Conditions ("Terms") govern the booking and use of travel services offered by Fortuna Expeditions (“we”, “us”, “our”). By submitting a reservation request, completing payment, or participating in any tour or transfer, you agree to these Terms.

1. Bookings & Payments

  • Bookings are confirmed once you receive our written confirmation (email) and any required deposit is paid.
  • Payment methods: major credit/debit cards or other options we provide in writing.
  • The lead traveler warrants they are authorized to make a booking on behalf of all participants and will share these Terms with their party.

2. Pricing & Inclusions

  • Prices are shown in U.S. Dollars (USD) unless otherwise stated and are based on current costs, taxes, and fuel at the time of publication.
  • Inclusions/exclusions are specified on each tour page or proposal. Personal expenses, tips, and optional add-ons are not included unless clearly stated.
  • Obvious errors/typos in pricing may be corrected, and you will be offered a refund if you do not accept the corrected price.

3. Cancellations & Changes

  • Client cancellations: Unless otherwise stated on your quote or tour page, cancellations received:
    • ≥ 7 days before service: full refund minus processing fees.
    • 3–6 days before: 50% refund.
    • < 72 hours before or no-show: non-refundable.
  • Date/participant changes are subject to availability and may incur fees.
  • Supplier/force majeure changes: We may modify or cancel a service for safety, weather, road closures, strikes, or other circumstances beyond our control. Where possible, we will offer a suitable alternative or a refund of the affected portion.

4. Travel Requirements

  • You are responsible for valid travel documents, visas, health requirements, and punctual arrival at the pick-up point.
  • Some activities have age, health, or fitness restrictions. Please inform us of medical conditions, allergies, or mobility considerations at the time of booking.
  • Minors must be accompanied by a responsible adult.

5. Participant Conduct

We may refuse service or remove any person who poses a safety risk, engages in illegal behavior, or disrupts the experience, without refund.

6. Liability & Disclaimers

  • Outdoor activities involve inherent risks (terrain, wildlife, weather). By participating, you accept these risks and agree to follow guide instructions.
  • To the maximum extent permitted by law, our liability is limited to the amount you paid for the affected service. We are not liable for indirect, incidental, or consequential losses.
  • You are advised to purchase comprehensive travel insurance.

7. Intellectual Property

Website content, itineraries, text, photos, graphics, and logos are owned by Fortuna Expeditions or its licensors and protected by applicable law. You may not copy, distribute, or use them commercially without written permission.

8. Governing Law

These Terms are governed by the laws of Costa Rica. Any dispute shall be submitted to the competent courts in Costa Rica, without prejudice to mandatory consumer protections in your country of residence where applicable.

This Privacy Policy explains how Fortuna Expeditions collects, uses, and shares your personal information when you visit our website, contact us, or book our services.

What We Collect

  • Contact & booking data (name, email, phone, travel dates, group size, preferences, pickup location).
  • Transaction data (amounts, currency, status). We use reputable processors; we do not store full card data on our servers.
  • Usage data & cookies (pages viewed, device/browser info, IP, referrer) to improve performance and analytics.

How We Use Data

  • Provide quotes, manage reservations, deliver tours and transfers.
  • Respond to inquiries and offer trip planning assistance.
  • Improve our website, safety, and customer experience.
  • Send important service messages; marketing emails only with your consent (you can opt out anytime).
  • Comply with legal obligations (tax, accounting, fraud prevention).

Sharing & Transfers

We share data with trusted suppliers strictly to operate your services (e.g. transport, guides, activity providers), with payment processors, and with professional/IT/analytics partners under appropriate safeguards. We do not sell your personal information.

Security & Retention

We apply reasonable technical and organizational measures to protect data. We retain information only as long as necessary for the purposes described or as required by law, then securely delete or anonymize it.
